Registering different marks as trademarks are particularly important from the aspect of protecting the rights of owners. Infringers prefer using the good reputation and well-know nature of attractive, widely known, and therefore, valuable marks, using the market advantages of the brands made widely-known by the owners. In the possession of a registered trademark it is quicker and easier to fight against the infringers. In trademark infringement lawsuits a preliminary injunction may be ordered within a few months by holding a valid trademark under protection in the territory of Hungary. Thus, infringers may be prohibited to conduct further illegal activities even before a court judgement is passed.

Trademarks may be used legally, based upon and in accordance with the terms and conditions of a license agreement concluded with the trademark owner. In the license agreement the conditions of trademark use may be specified, the time and territorial limits of legal trademark use as well as the royalty fee, commonly known as license fee, to be paid as compensation for the trademark use.

As per the types of trademarks there are national, community and international trademarks. Depending on which kind of trademark will be registered, the period of registration, its steps and the costs are different. The length of the trademark registration procedure is affected, if a trademark owner files an appeal against the registration of the mark in question. It is worth planning in advance, if possible, and to determine the registration procedures upon the future plans and future operation of the company.

Patterns, designs, patents and works under copyright protection also belong to the group of intellectual properties. Separate acts regulate the provisions of these intellectual properties.

In case of failure of an amicable settlement, court procedure may be initiated. Based on our several years of experience in this field the Law Office undertakes to represent clients in such court cases, in the above mentioned trademark registration procedures as well as in the contractual procedure of license agreement.
